1. Acceptance of Terms

By creating an account or using Boland Webworks services, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the platform. Continued use after updates are published constitutes acceptance of the updated Terms.

2. Eligibility and Account Registration

  • Accounts are currently created via Google OAuth.
  • You must provide accurate and complete account and project information.
  • The platform is intended for adults (18+) or users with lawful guardian consent.
  • You are responsible for maintaining account confidentiality and for activities under your account.

3. Services, Hosting, and Project Delivery

  • BWW provides web development, support services, and related SaaS tooling.
  • BWW platform infrastructure is operated using providers such as Vercel and Firebase/Google Cloud.
  • Client domain registration and DNS may be managed through Zoho, Truehost, Vercel, or other client-approved providers.
  • Client business email services may be provisioned through Zoho Mail or another agreed provider.
  • For client websites delivered by BWW, hosting is typically set up on Vercel by default unless the client requests another hosting provider.
  • Where a different host is chosen, deployment timelines, support scope, and cost may change based on that environment.
  • Where required by project size or architecture, solutions may be deployed on platforms such as Shopify or AWS.
  • We aim for reliable and high-quality outputs, but bugs, delays, and downtime can still occur in real production environments.

4. User Content, Uploads, and Intellectual Property

  • You retain ownership of content you submit (including PDFs and project requirements), subject to rights you grant in this section.
  • You grant BWW a limited license to process, store, and use submitted content solely to provide requested services.
  • You confirm that uploaded content is lawful and does not infringe third-party rights or contain malicious material.
  • Tikwedren prompt content is published after rights checks and may be removed if a valid ownership dispute is received.

5. Acceptable Use

  • Do not misuse the platform, attempt unauthorized access, or interfere with service operations.
  • Tikwedren aliases must remain lawful and non-abusive.
  • Attempts to manipulate rankings (including automation, spoofing, or exploit-based submissions) may lead to score invalidation, moderation actions, suspension, or termination.

6. Third-Party Services

BWW uses third-party services and infrastructure providers for hosting, authentication, storage, domain management, communication, and delivery. Examples include Vercel, Firebase/Google Cloud, Zoho, Truehost, Shopify, and AWS, depending on project requirements. These providers have their own terms and policies. BWW is not responsible for outages or failures caused by third-party platforms outside our reasonable control.

7. Fees, Refunds, and Cancellations

  • Project and service fees are governed by the accepted quotation or written agreement.
  • Unless otherwise agreed in writing, payments are non-refundable after work has commenced, subject to rights that cannot be excluded under applicable law.
  • If recurring services are cancelled, a notice period may apply as stated in the applicable service agreement.

8. Suspension and Termination

  • We may suspend or restrict accounts for security, abuse, or Terms violations.
  • We may terminate access where breaches are serious, repeated, or unresolved after reasonable notice.
  • Termination does not remove outstanding payment obligations, legal rights, or liabilities accrued before termination.

9. Liability, Warranties, and Governing Law

  • Services are provided on an "as available" basis, and we do not guarantee uninterrupted, error-free operation.
  • To the fullest extent permitted by law, BWW excludes indirect or consequential damages and limits liability to direct losses reasonably linked to proven breach.
  • Nothing in these Terms excludes rights or remedies that cannot be lawfully excluded under South African law.
  • These Terms are governed by South African law, including POPIA and ECTA.
  • Disputes are subject to the courts of Cape Town, South Africa, unless law requires otherwise.

10. Changes and Contact

  • We may update these Terms from time to time.
  • Changes are effective when published with an updated "Last Updated" date.
