Terms of Service

1. Acceptance of Terms

By creating an account or using Boland Webworks' SaaS platform, you agree to these Terms of Service ("TOS"). If you do not agree, you may not use the platform. Your continued use constitutes acceptance of any updates or modifications.

2. Account Registration

• Accounts are created via Google OAuth.
• Users must provide accurate name, email, and project requirements.
• Access is strictly for adults (18+).
• You are responsible for maintaining the confidentiality of your account and credentials.

3. User Responsibilities

• Users must ensure uploaded content (PDFs, project requirements) is lawful and free of copyrighted or malicious material.
• Users retain ownership of their content. Boland Webworks may process content for project delivery but does not claim ownership.

4. Service Provision

• Boland Webworks delivers SaaS services to enhance website/project development.
• Websites are coded by hand, supported by specialised software (Cursor, IntelliJ, GitHub).
• We strive to provide accurate and secure outputs; however, bugs or errors may occur.
• BWW is not liable for downtime or defects but will correct issues promptly.

5. Third-Party Tools

BWW uses third-party tools and platforms (Cursor, IntelliJ, GitHub, Meta Ads) to enhance service delivery. BWW is not responsible for any errors, downtime, or issues arising from third-party services.

6. Payment, Refunds, and Cancellations

• All payments are non-refundable.
• Users may cancel services with a 1-month notice; no partial refunds will be issued.
• Cancellation will terminate future service obligations but does not affect prior obligations or liabilities.

7. Suspension and Termination

• Violation of TOS may result in account suspension pending investigation.
• Following investigation, accounts may be:
• Permanently banned, or
• Temporarily suspended with a trial/restriction period.
• BWW reserves the right to terminate accounts at its discretion for breach of TOS.

8. Governing Law and Dispute Resolution

• This TOS is governed by South African law, including POPIA and ECTA.
• All disputes must be resolved in the courts of Cape Town, South Africa.

9. Changes to Terms

• BWW may update these TOS at any time.
• Changes will be effective immediately upon posting, and the "Last Updated" date will reflect the most recent version.
